新北市，樹林 – Oct 11, 2018 – 米国最高裁判所 (Supreme Court of the United States)は、2018年10月1日、日亜化学社による上告請求を棄却する最終判決を行い、これにより、日亜化学社保有の白色光LED特許US 5,998,925及びUS 7,531,960の対象となる請求項の全てについて無効であることが再度認定されました。本件は三審を経て確定し、EVERLIGHT社の最終勝利となりました。 EVERLIGHT社は日亜化学社保有のYAG白色光LED特許2件 (US 5,998,925及びUS 7,531,960)について、2012年4月20日より、米国ミシガン州東部地区連邦地方裁判所において特許無効及び非侵害の確認訴訟を提起しておりましたが、陪審員による12日間の審理を経て、2015年4月22日、それぞれ特許進歩性欠如、特許実施可能性要件違反等を理由として、日亜化学社が主張する請求項の全ては無効とされ、2016年1月25日には、同裁判所裁判官によって陪審員による当該決定を確認する判決がなされました。日亜化学社はこの判決を不服として、代理人法律事務所を替えて連邦巡回区控訴裁判所(CAFC)に控訴していましたが、2018年3月30日、CAFCにおいても再度特許無効が確認され、日亜化学社の控訴は失敗しました。その後、日亜化学社は再度代理人法律事務所を替えて、米国最高裁判所に上告しましたが、最高裁判所においても特許無効と認定され、日亜化学社は再度敗訴しました。 本件について、EVERLIGHT社知財部部長である林咸嘉は「特許権の最も主要な存在目的はイノベーションによる研究開発の成果を保護することであり、産業の発展を促進させるために設立された法律である。しかしながら、自己の特許権を以って競合他社に対して訴訟提起し、自己に有利に市場を操作しようとする行為は決して許されるべきものではなく、市場の公平な競争の実現のために戦うべきである。」とコメントしています。 日亜化学社保有のYAG白色光LED特許の状況については以下のとおりです。   特許番号 日付 状況 1 US5998925 2018年10月1日 米国最高裁判所においてCAFCによる判決が維持され、日亜化学社によって提起された請求項の無効が確認される。 2 US7531960 2018年10月1日 米国最高裁判所においてCAFCによる判決が維持され、日亜化学社によって提起された請求項の無効が確認される。 3 US7915631 2018年4-5月 米国Central District of Californiaにおいて特許無効と判定される。 4 US7901959 2018年5月 米国Central District of Californiaにおいて特許無効と判定される。 5 TW 383508 2018年4月 台湾智財法院において特許無効と判定される。 6 CN200610095837.4 2017年9月 …
